All our services, quotations and agreements are governed by the standard trading conditions that apply in the country of the contracting DBTL office. An overview per country is listed at the bottom of this page.

These conditions include limitations of liability. A copy is available on request and is sent with our quotations.

We act either as a forwarding agent or as a carrier, and the capacity determines our obligations and liability.

• As a forwarding agent, our main obligation is to arrange the forwarding of the goods, in our own name or in the name of the customer but on the customer's authority and behalf, including the related services, formalities and contracts with third parties.
• As a carrier, our main obligation is to carry the goods, either ourselves or through carriers we contract with. We act as carrier when we transport goods with our own vehicles or when we issue a transport document in our own name.

These terms do not waive any right we hold, nor do they create liability beyond what follows from the applicable international conventions and legislation.

By entrusting goods to us, the customer confirms that the goods are its property, or that it is authorised by the owner, shipper or consignee to dispose of them, and accepts these terms on their behalf as well.

Quotations are valid for the period stated and are based on the information, weights, volumes and schedules provided by the customer. Rates may be adjusted if that information changes, or where surcharges are imposed by carriers or authorities, including fuel, currency, congestion and security surcharges.

• Provide accurate and complete cargo details, documentation and instructions in time.
• Declare dangerous, temperature-sensitive or otherwise special cargo before booking.
• Guarantee that the cargo may be exported, imported and transported lawfully, including under customs, sanctions and waste shipment rules.
• Ensure the verified gross mass of containers is declared in accordance with SOLAS.

Our liability is limited in accordance with the applicable standard trading conditions and the mandatory international transport conventions. We are not liable for indirect or consequential loss, including loss of profit, loss of production or delay damages, unless agreed otherwise in writing.

Cargo insurance is not included unless expressly agreed in writing. We arrange it on request and on the instruction of the customer.

Invoices are payable within the agreed term. In case of late payment, statutory interest and recovery costs apply. We may retain cargo and documents for outstanding amounts to the extent permitted by the applicable conditions.

We are not liable for failure to perform caused by circumstances beyond our control, including port congestion, strikes, blank sailings, weather, war and government measures.

Any claim must be notified to us in writing, with reasons, within the periods set in the applicable standard trading conditions. Claims that are not notified in time, or not brought before the competent court within the prescribed period, lapse.

We have a right of retention and a lien on the goods, documents and monies entrusted to us, as security for all amounts owed to us, in accordance with the applicable standard trading conditions and Belgian law.

We treat the information we receive from you as confidential, and we expect the same of you. Both parties take appropriate technical and organisational measures to protect the confidentiality and integrity of the data exchanged, also after the assignment has been completed.

Belgian law applies. Disputes fall under the exclusive jurisdiction of the courts of the judicial district of our registered office, unless the applicable standard trading conditions provide otherwise.

Contact details you provide when you request a quote, send an enquiry or apply for a job: name, company, e-mail address, telephone number and the content of your message.

Shipment data exchanged in the course of our services: consignee and shipper details, addresses, references and documentation required for customs and carriers.

Technical data collected automatically when you visit this website: IP address, browser type, pages visited and time of visit.

Depending on your relationship with us, we process data of contact persons at customers and suppliers, of management members in the context of due diligence, of consignees and shippers in customs files, and of job applicants.

• Customer and supplier management: name, professional e-mail address, telephone number, and bank details in the case of sole traders.
• Know your client: identification data of the CEO or another member of management.
• Customs handling: contact and identification details of seller, consignee and shipper.
• Job applicants: the CV, cover letter and any further information provided during the selection process.

To answer enquiries and prepare quotations, to perform the transport and customs services agreed with you, to comply with legal obligations such as customs and waste shipment regulations, and to keep the website secure and improve it.

Performance of a contract, compliance with a legal obligation, and our legitimate interest in running and securing our business. Where consent is required, for example for non-essential cookies, we ask for it separately.

We share data only where needed to carry out the transport: carriers, agents, terminals, customs authorities and, where relevant, our own offices abroad. Where data is transferred outside the European Economic Area, we rely on the safeguards foreseen by the GDPR. We never sell personal data.

We work with external service providers for IT, hosting and support, for customs handling and, where relevant, for assessments during recruitment. Each of them acts on our instructions under a data processing agreement and may not use your data for its own purposes. Access is limited to what is needed to perform the service.

In the event of a merger, acquisition or sale of all or part of our business, personal data may be transferred to the party involved. We will inform you if that happens.

• Customer and supplier management: up to ten years after the end of the relationship.
• Know your client: until the end of the relationship.
• Job applicants: up to one year after the application.
• Customs, transport and accounting records: for the statutory retention period.

You have the right to access your data, to have it corrected or deleted, to restrict or object to processing, and to data portability. Send your request to belgium@dbtl.com. You may also lodge a complaint with the Belgian Data Protection Authority (Gegevensbeschermingsautoriteit, Drukpersstraat 35, 1000 Brussels).
